Divorce: Clean Up Your Social Media
By: Chad M. Layton, Esq.
Said best by the great Bob Dylan, “The times they are a changin’.
Assets, income, standard of living and time-sharing disputes are ripe for spouses and attorneys to uncover damning evidence on twitter, instagram, facebook and the like. As a regular course of business, the staff and clients of seasoned family law attorneys now scour social media to gather potential evidence to be used against the former husband or wife.
Social media, text messages and email correspondence are all forms of evidence which are introduced as evidence in family law proceedings every day. Armed with this knowledge, we advise our clients to tread carefully on social media and when communicating with their significant other in writing.
On the flip side, it may also be prudent to gather and save any photographs and/or postings by your significant other which may support your position in the event litigation becomes necessary. This is not a license to kill or encouragement to engage in vexatious litigation. Instead, it is a simple exercise which may provide you and your attorney with useful evidence down the road to be used to negotiate a strong settlement for you and/or at trial.
The goal should continue to be a settlement agreement which satisfies the most important goals you have set out at the start of the case with your lawyer.
If an amicable resolution proves untenable, our law firm has extensive trial experience in family law matters.
